This is a translation. In case of any discrepancy, the Portuguese (Brazil) version prevails.
These terms govern the use of the apps and website of R F A R CARAPETO INFORMATICA (UPTREND DIGITAL SOLUTIONS), CNPJ 33.766.592/0001-06, São Paulo/SP, Brazil. By installing or using our apps, you (the “merchant”) agree to these terms.
1. Service
The apps are offered as software as a service, integrated with the merchant’s e-commerce platform through the official APIs. Features may be changed or improved over time.
2. Installation and account
The merchant is responsible for their store account, for the permissions granted at installation and for the settings made in the app.
3. Plans and payment
Plans and prices are shown on the app’s page in the platform’s app store. Billing is done through the method indicated by the platform. You may cancel at any time by uninstalling the app; there is no pro-rata refund for the period already billed, unless otherwise required by law.
4. Acceptable use
Using the apps for unlawful purposes, to infringe the rights of third parties or to attempt to compromise the security of the service is prohibited.
5. Data and privacy
Data processing is governed by our Privacy Policy. The merchant, as controller of their customers’ data, is responsible for informing them appropriately.
6. Availability and liability
We use reasonable efforts to keep the service available, but it may be interrupted, including by failures of the e-commerce platform or of third parties. To the maximum extent permitted by law, our liability is limited to the amount paid by the merchant in the 3 months preceding the event.
7. Intellectual property
The software, the brand and the content belong to Uptrend. The merchant is granted a non-exclusive, non-transferable license to use the app while it is installed.
8. Changes and termination
We may update these terms and will give notice of material changes. We may suspend access in case of breach of these terms.
9. Governing law and jurisdiction
Brazilian law applies. The courts of the Judicial District (Comarca) of São Paulo/SP are chosen as the venue, without prejudice to consumer rights.
